Terms of Service

1. Who we are and what these terms cover

WA Pixel ("the Service") is a WhatsApp Business messaging platform operated by EqualPixels, headquartered in Manama, Kingdom of Bahrain ("we", "us"). These Terms of Service govern your access to and use of the Service, including the web application at wa-pixel.com, its APIs, and related tools. By creating an account or using the Service you agree to these terms on behalf of yourself and the business you represent.

2. The Service and your WhatsApp number

The Service provides campaign broadcasting, chat automation (including AI-powered replies), a shared team inbox, forms, analytics and related features on top of the WhatsApp Business Platform (Cloud API) operated by Meta. You connect your own WhatsApp Business number and remain its owner at all times. Your use of WhatsApp itself is additionally governed by Meta's own terms and policies, including the WhatsApp Business Messaging Policy, which you agree to comply with.

3. Relationship with WhatsApp and Meta

WA Pixel is an independent product of EqualPixels. We are not affiliated with, endorsed by, or sponsored by WhatsApp LLC or Meta Platforms, Inc. "WhatsApp" and "Meta" are trademarks of their respective owners. Message delivery, template approvals, messaging limits and quality ratings are determined by Meta's systems, not by us.

4. Accounts and teams

You are responsible for the accuracy of your account information, for safeguarding credentials, and for the actions of team members you add to your workspace (owners, admins and agents). Notify us promptly of any unauthorised use. We may suspend accounts that present a security risk to the Service or to other customers.

5. Acceptable use — messaging rules

You agree to message only recipients who have given valid prior consent (opt-in), to honour opt-outs immediately (the Service processes STOP requests automatically), and to comply with applicable messaging and data-protection laws in the markets you contact — including, without limitation, UAE TDRA and Saudi CITC anti-spam rules and applicable PDPL data-protection laws. Prohibited: purchased or harvested contact lists, unlawful, deceptive or harmful content, and any use that violates Meta's WhatsApp policies. We may suspend or terminate accounts engaged in spam or unlawful messaging.

6. Subscriptions, billing and Meta fees

Paid plans are billed in advance on a monthly subscription basis (via our payment processor) and include a monthly message quota as described on the pricing page. You may cancel at any time, effective at the end of the current billing period; fees already paid are non-refundable except where required by law. Meta's per-message fees are separate, are charged by Meta to your WhatsApp Business account, and are your responsibility.

7. Your data

You retain all rights to the contact lists, messages and other content you process through the Service ("Customer Data"). You grant us the limited rights needed to operate the Service (transmitting messages, storing conversation history, generating analytics). You are responsible for having a lawful basis to process the personal data of your contacts. Our handling of personal data is described in the Privacy Policy. Upon account closure we delete or anonymise Customer Data within a reasonable period, except where retention is legally required.

8. AI features

The Service includes AI-assisted features (such as automated replies and content generation). AI output can be inaccurate; you are responsible for reviewing automated configurations, for the knowledge bases you provide, and for all messages sent from your number, whether composed by your team, by flows, or by AI.

9. Availability and changes

We aim for high availability but the Service is provided "as is" and "as available", without warranties of uninterrupted or error-free operation — including because we depend on third-party platforms (Meta, hosting and payment providers). We may improve or modify features over time; material reductions in paid functionality will be communicated in advance where reasonably possible.

10. Limitation of liability

To the maximum extent permitted by law, EqualPixels shall not be liable for indirect, incidental, special or consequential damages, loss of profits, revenue or data, and our aggregate liability arising out of or relating to the Service in any twelve-month period shall not exceed the amounts you paid us for the Service in that period. Nothing in these terms excludes liability that cannot be excluded under applicable law.

11. Termination

You may stop using the Service and cancel at any time from Billing. We may suspend or terminate access for material breach of these terms (including the acceptable-use rules in section 5) or where required to protect the Service, other customers, or our standing with Meta. Sections that by their nature should survive termination (including 3, 7, 10 and 12) survive.

12. Governing law and disputes

These terms are governed by the laws of the Kingdom of Bahrain, and the courts of Bahrain have exclusive jurisdiction, except where mandatory local law grants you additional rights. Before formal proceedings, we both agree to attempt good-faith resolution via info@equalpixels.ae.

13. Changes to these terms

We may update these terms as the Service evolves. Material changes will be announced on this page (and by email or in-app notice for significant changes) with an updated "last updated" date. Continued use after changes take effect constitutes acceptance.
